Overview

Welcome to XSALTRU.

The terms “XSALTRU,” “we,” “us,” and “our” refer to XSALTRU. We operate this website and online store, including the information, content, features, products, tools, and services offered through it (collectively, the “Services”).

Our store is powered by Shopify, which provides technology that enables us to offer the Services.

These Terms of Service, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies referenced through the Services, govern your access to and use of XSALTRU.

By accessing, browsing, interacting with, or purchasing through the Services, you agree to these Terms.

If you do not agree, you should not use the Services.

1. Eligibility, Access & Accounts

You must be at least the age of majority in your state, province, or jurisdiction of residence to make a purchase through the Services, or otherwise have the authorization required by applicable law.

When using the Services, you agree to provide accurate, current, and complete information, including billing, payment, contact, and shipping information.

You are responsible for safeguarding your account credentials and for activity conducted through your account.

You may not sell, transfer, assign, or license your account to another person without our permission.

2. Products & Product Information

We make reasonable efforts to accurately display and describe our products.

Actual colors, textures, print placement, sizing appearance, or other visual characteristics may vary slightly because of device displays, production methods, garment batches, materials, or normal manufacturing tolerances.

These reasonable variations do not automatically constitute defects. This does not affect your rights when an item is damaged, defective, misprinted, incorrect, or materially different from what you ordered.

Product descriptions, availability, pricing, designs, and specifications may change without notice.

We may discontinue products or limit quantities available to any person, household, geographic area, or jurisdiction where permitted by law.

3. On-Demand Production

Many XSALTRU products are produced on demand after an order is placed.

Because fulfillment may begin shortly after purchase, changes and cancellations are not guaranteed once production has started.

Please carefully review your product, size, color, quantity, shipping address, and other order details before submitting your order.

Returns, exchanges, replacements, and refunds are governed by our Return & Refund Policy and applicable law.

4. Orders

Submitting an order constitutes an offer to purchase.

XSALTRU may accept, reject, limit, or cancel an order where reasonably necessary, including because of:

Product or inventory availability
Pricing or listing errors
Payment authorization problems
Suspected fraud or unauthorized activity
Shipping or geographic restrictions
Legal or regulatory requirements

An order is not final until payment has been successfully processed and the order has been accepted for fulfillment.

If we cancel an order after payment has been collected, we will refund the applicable amount.

Unless we expressly authorize otherwise, products purchased through the consumer store are intended for personal or household use and not unauthorized commercial resale.

5. Prices, Taxes & Payment

Prices and promotions may change without notice.

The price charged will be the price displayed and confirmed at checkout, subject to correction of obvious errors as permitted by applicable law.

Unless otherwise stated, displayed product prices may exclude:

Shipping
Handling
Sales or similar taxes
Customs duties
Import taxes
Other government-imposed charges

International customers are responsible for customs, duties, taxes, and import charges imposed by their jurisdiction unless otherwise stated at checkout or required by law.

You represent that you are authorized to use the payment method submitted with your order.

You agree to provide accurate billing and payment information and to promptly update information necessary to complete your transaction.

6. Shipping & Delivery

Delivery dates and transit times are estimates unless we expressly state otherwise.

Delays may occur because of carrier operations, weather, customs, supply-chain disruptions, incorrect addresses, emergencies, or circumstances outside our reasonable control.

If we cannot ship an order within a legally required or promised timeframe, we will provide any notice, cancellation option, consent request, or refund required by applicable law.

Risk of loss will transfer as provided by applicable law. Nothing in these Terms eliminates rights you may have for goods that are lost, damaged, or not delivered.

Lost packages, incorrect addresses, returned shipments, and delivery-related claims are also handled under our Return & Refund Policy.

7. Returns, Refunds & Order Issues

Our Return & Refund Policy governs returns, exchanges, damaged merchandise, defects, misprints, fulfillment errors, lost packages, cancellations, and refunds.

Because products may be made on demand, we generally do not accept returns or exchanges solely because of buyer's remorse, an incorrectly selected size or color, or a change of mind, except where required by applicable law.

Nothing in these Terms or our Return & Refund Policy limits consumer rights that cannot legally be waived.

8. Intellectual Property

The Services and their original content—including XSALTRU names, branding, logos, artwork, graphics, photographs, videos, audio, music-related material, text, product designs, layouts, and other creative material—are owned by or licensed to XSALTRU and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not reproduce, republish, distribute, sell, modify, create derivative works from, publicly display or perform, or commercially exploit XSALTRU content without prior written authorization.

Use of the Services does not transfer ownership of any intellectual-property right to you.

XSALTRU names, logos, product names, designs, and slogans may constitute trademarks or other protected brand identifiers of XSALTRU.

Third-party names, trademarks, and intellectual property remain the property of their respective owners.

9. Personal & Noncommercial Use

You may access the Services for lawful personal use.

You may not exploit, reproduce, copy, sell, resell, or commercially use substantial portions of the Services without authorization.

Nothing in this section prevents ordinary sharing of publicly available XSALTRU pages or links for legitimate purposes.

10. Third-Party Services & Tools

The Services may include tools, applications, payment providers, fulfillment services, social platforms, music platforms, embedded content, or functionality operated by third parties.

These services may operate under their own terms and privacy policies.

To the extent permitted by law, XSALTRU is not responsible for third-party services that we do not control.

Your use of an optional third-party service is at your discretion and subject to that provider's applicable terms.

11. Third-Party Links

The Services may link to websites or services operated by third parties.

A link does not necessarily constitute our endorsement of that third party.

XSALTRU is not responsible for the content, accuracy, security, availability, policies, products, or practices of websites or services we do not control.

Please review applicable third-party terms and policies before completing transactions with them.

12. Relationship With Shopify

XSALTRU uses Shopify technology to operate portions of the store and Services.

Purchases from the XSALTRU store are transactions between you and XSALTRU, not purchases from Shopify.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for XSALTRU merchandise, fulfillment decisions, customer-service decisions, or obligations arising directly from a purchase from XSALTRU.

Nothing in this section limits rights or remedies that cannot legally be waived.

13. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy laws.

Because Shopify hosts and supports portions of the Services, certain personal information may also be processed by Shopify and other service providers necessary to operate our store, process payments, fulfill orders, provide analytics, prevent fraud, and deliver other store functionality.

14. Feedback, Reviews & Submissions

If you voluntarily submit reviews, suggestions, feedback, ideas, photographs, comments, or similar content to XSALTRU, you represent that you have the rights necessary to provide that material.

Unless otherwise agreed in writing, you grant XSALTRU a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and promote that material in connection with XSALTRU and its Services, subject to applicable law.

You may not submit content that violates another person's intellectual-property or privacy rights, is fraudulent or deliberately misleading, contains malicious software, is unlawful, or falsely impersonates another person.

You remain responsible for content you submit.

15. Errors, Inaccuracies & Omissions

The Services may occasionally contain typographical errors, incorrect product information, pricing errors, availability errors, or other inaccuracies.

To the extent permitted by law, we may correct errors and update information.

If an error materially affects an order already submitted, we may contact you to correct the order or cancel it and issue the appropriate refund.

16. Prohibited Uses

You may not use the Services:

For unlawful, fraudulent, or malicious purposes
To violate applicable laws or regulations
To infringe intellectual-property, privacy, publicity, or other rights
To transmit malware or harmful code
To impersonate another person or entity
To submit false or misleading information
To conduct phishing, spam, fraud, or abusive activity
To interfere with the security or operation of the Services
To circumvent access controls or security protections
To collect personal information unlawfully

We may restrict or terminate access when reasonably necessary to protect XSALTRU, customers, third parties, or the Services.

Automated tools, search engines, shopping agents, AI assistants, and other software may access or interact with portions of the Services when such access is authorized by XSALTRU, Shopify, our technology providers, or applicable platform settings.

Automated systems may not:

Circumvent security or access controls
Defeat CAPTCHAs or anti-abuse mechanisms
Conceal malicious or unauthorized automated activity
Conduct unauthorized bulk scraping or data extraction
Interfere with store availability or performance
Use XSALTRU content in violation of applicable law or these Terms

We may use technical measures to control automated access to the Services.

Nothing in this section is intended to prevent legitimate product discovery, indexing, accessibility technology, or authorized commerce integrations.

18. Suspension & Termination

We may suspend, restrict, or terminate access to all or part of the Services if we reasonably believe you have violated these Terms, created security or fraud risks, misused the Services, or engaged in unlawful conduct.

Termination does not eliminate payment obligations or other responsibilities that arose before termination.

Provisions that by their nature should survive termination—including intellectual-property provisions, liability provisions, indemnification obligations, dispute provisions, and governing-law provisions—will remain effective.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Except where expressly stated or legally required, XSALTRU does not guarantee that the Services will always be uninterrupted, error-free, completely secure, or available.

To the fullest extent permitted by law, we disclaim warranties that may otherwise arise by implication.

Nothing in this section excludes any warranty, guarantee, remedy, or consumer protection that cannot legally be excluded.

20. Limitation of Liability

To the fullest extent permitted by applicable law, XSALTRU and its affiliates, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the Services or products purchased through them.

This may include lost profits, lost revenue, loss of data, or similar economic losses where such limitations are legally permitted.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Your statutory consumer rights remain unaffected.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless XSALTRU and its affiliates, officers, employees, contractors, licensors, service providers, and agents against third-party claims, liabilities, losses, damages, or reasonable expenses arising from:

Your material breach of these Terms;
Your unlawful use of the Services; or
Your violation of a third party's rights.

This provision does not impose obligations that cannot lawfully be imposed on a consumer.

22. Severability

If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed as necessary.

The remaining provisions will continue in effect.

23. Waiver & Entire Agreement

Failure by XSALTRU to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other terms expressly incorporated into them constitute the agreement governing your use of the Services.

Nothing in this section limits representations or consumer rights that cannot legally be excluded.

24. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.

XSALTRU may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, service-provider transition, or other legitimate business transaction, subject to applicable law.

25. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where mandatory law requires otherwise.

Subject to any non-waivable consumer rights or jurisdictional protections, disputes relating to these Terms or the Services may be brought in the appropriate state or federal courts located in New York, New York.

Consumers retain any rights concerning governing law, venue, or jurisdiction that cannot legally be waived.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, business operations, technology, policies, or applicable requirements.

The current version will be posted at our Terms of Service page with an updated effective date.

Where applicable law requires additional notice or consent for a material change, we will provide it.

Changes will not retroactively eliminate rights that have already accrued where prohibited by law.

27. Consumer Rights

Nothing in these Terms is intended to waive, restrict, or eliminate a consumer right that cannot legally be waived.

If applicable consumer-protection law provides greater rights than these Terms, the applicable legal requirements control.
